1. Acceptance of Terms

By creating an account or using Utalus ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Utalus provides a real estate intelligence platform that offers property data, automated valuations (AVM), deal finding tools, market reports, and related features. Access is provided on a subscription basis.

3. Accounts

  • You must be at least 18 years old to use Utalus.
  • You are responsible for maintaining the security of your account credentials.
  • You are responsible for all activity that occurs under your account.
  • You must provide accurate, current information when registering.
  • One person may not create multiple free trial accounts.

4. Subscriptions & Billing

  • Paid plans are billed monthly or annually in advance.
  • 14-day free trials are available on all paid plans. No credit card is required to start a trial.
  • Subscriptions auto-renew unless cancelled before the renewal date.
  • Refunds are issued at our discretion and evaluated case-by-case.
  • We reserve the right to change pricing with 30 days' notice to existing subscribers.

5. Acceptable Use

You may not use Utalus to:

  • Scrape, bulk-download, or re-sell data from the platform.
  • Harass, stalk, or harm any individual using information obtained through the Service.
  • Violate any applicable local, state, national, or international law.
  • Attempt to gain unauthorized access to our systems or other users' accounts.
  • Use automated tools to access the Service beyond any published API rate limits.

6. Data Accuracy Disclaimer

Property data, AVM valuations, and market reports provided by Utalus are sourced from third-party providers and public records. All data is provided for informational purposes only. Utalus does not guarantee the accuracy, completeness, or timeliness of any data. You should independently verify all information before making any investment, lending, or real estate decisions. Utalus is not a licensed real estate broker, appraiser, or financial advisor.

7. Intellectual Property

All software, design, content, and trademarks on the Utalus platform are owned by Utalus or its licensors. You receive a limited, non-exclusive license to use the Service for your own business purposes. You may not copy, modify, distribute, or create derivative works from our platform.

8. Termination

You may cancel your account at any time. We may terminate or suspend your account if you violate these Terms, with or without notice. Upon termination, your right to access the Service ends immediately.

9. Limitation of Liability

To the maximum extent permitted by law, Utalus shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability for any claim shall not exceed the amount you paid to Utalus in the 12 months preceding the claim.

10. Changes to Terms

We may modify these Terms at any time. We will notify registered users of material changes via email. Continued use of the Service after notice constitutes acceptance of the updated Terms.
